1. INTRODUCTION

Welcome to Newban Boda (“Company”, “we”, “our”, “us”).

These Terms and Conditions govern your access to and use of the Newban Boda mobile application, website, and all related transportation and delivery services.

By creating an account or using our services, you agree to be legally bound by these Terms.

If you do not agree, you must not use the platform.

2. ABOUT NEWBAN BODA

Newban Boda is a technology-based transportation platform that connects passengers with independent riders for:

  • Motorcycle ride-hailing services
  • School pick-up and drop-off transport services
  • Parcel and document delivery services
  • Scheduled and on-demand rides

We act as an intermediary platform and do not directly employ riders, who operate as independent service providers.

3. ELIGIBILITY

To use Newban Boda, you must:

  • Be at least 18 years old, OR
  • Be a parent/guardian using the service on behalf of a child
  • Provide accurate and complete registration information

4. USER ACCOUNTS

Users are responsible for:

  • Maintaining confidentiality of login credentials
  • Ensuring all account information is accurate
  • All activities conducted through their account
  • Immediately reporting unauthorized access

5. SERVICES

Newban Boda provides a platform for booking transportation services.

We do not guarantee uninterrupted availability of services due to:

  • Traffic conditions
  • Weather conditions
  • Technical failures
  • Rider availability
  • Force majeure events

6. SCHOOL TRANSPORT SERVICES

For school transport services:

  • Parents/guardians must provide accurate child information
  • Only authorized persons may receive the child at drop-off points
  • Newban Boda may refuse or suspend service if safety is at risk
  • Riders are required to follow strict child safety protocols

7. PRICING AND PAYMENTS

Users agree to pay all applicable charges including:

  • Ride fares
  • Delivery fees
  • Waiting time charges (if applicable)
  • Cancellation fees (where applicable)

Prices may vary depending on distance, demand, and operational factors.

Payments must be made through approved payment methods or cash where permitted.

8. CANCELLATIONS AND REFUNDS

  • Users may cancel rides before rider arrival
  • Cancellation fees may apply depending on timing
  • Refunds are issued at the Company’s discretion where applicable
  • Fraudulent claims may result in account suspension

9. USER CONDUCT

Users agree NOT to:

  • Misuse the platform or engage in illegal activity
  • Harass riders or staff
  • Provide false information
  • Damage or interfere with service operations
  • Use the service for unlawful transport of goods or persons

10. SAFETY RULES

All users must:

  • Follow rider instructions during trips
  • Wear helmets where required
  • Avoid distracting riders
  • Ensure children are properly supervised (where applicable)

Newban Boda prioritizes safety but users are responsible for their own conduct during trips.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Newban Boda is not liable for indirect or incidental damages
  • We are not responsible for delays caused by external factors
  • We are not responsible for actions of independent riders beyond reasonable control

Nothing in these Terms excludes liability where prohibited by law.

12. SUSPENSION OR TERMINATION

We may suspend or terminate accounts if users:

  • Violate these Terms
  • Engage in fraudulent or unsafe behavior
  • Misuse the platform
  • Pose a risk to riders, passengers, or children

13. INTELLECTUAL PROPERTY

All content, branding, logos, software, and systems belong to Newban Boda.

Users may not copy, modify, distribute, or reuse any part of the platform without written permission.

14. PRIVACY

Your use of Newban Boda is also governed by our Privacy Policy, which explains how we collect and use personal data.

15. MODIFICATIONS

We may update these Terms at any time.

Continued use of the platform means acceptance of updated Terms.

16. GOVERNING LAW

These Terms are governed by the laws of the Republic of Uganda.

Any disputes shall be handled by competent courts within Uganda.
